Terms & Conditions

IMPORTANT INFORMATION: Terms and conditions shall apply by committing/booking/approving commencement of work via email or online orders. All users of this site agree that access and use of this site is subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

1. Definitions and Interpretations

  • “Seller” shall mean Mount and Eve
  • “Buyer” shall mean the Buyer named on any quotation, invoice, purchase order, or any other documentation produced in relation to an agreement for the supply of Goods and/or Services, or any person acting on behalf of and with the authority of the Buyer.
  • “Price” shall mean the cost of the Goods/Services as agreed between the Seller and the Buyer subject to clause 5 hereof.
  • Goods” shall mean all Goods supplied by the Seller to the Buyer or ordered by the Buyer but not yet supplied and includes Goods described on any quotation, invoice, purchase order, or any other document including any recommendations and advice.
  • “Services” shall mean all Services supplied by the Seller to the Buyer and includes Installation, and any other Services described on any quotation, invoice, purchase order, or any other document including any recommendations and advice.

2. Jurisdiction

  •  All transactions shall be governed by and construed in accordance with the laws of the State of New South Wales.
  • The Buyer submits to the jurisdiction of the Courts of the State of New South Wales.

3. Offer and Acceptance

  • Any request from the Buyer to the Seller for the supply of Goods/Services however made shall constitute acceptance of the terms and conditions contained herein.
  • Where more than one Buyer has entered into an agreement with the Seller for the supply of Goods/Services, all Buyers shall be jointly and severally liable for all payments of the Price.
  • These terms become binding upon acceptance, and may thereafter only be altered or revoked with the written consent of the Seller.
  • Any changes to the Buyer’s details, including name, address, telephone, email, or any changes in ownership structure of the Buyer requires written notice of (10) days.

4. Goods / Services

  • The Goods/Services are as described on any quotation, invoice, purchase order, or any other document provided to the Buyer by the Seller.
  • Unless otherwise agreed in writing, the Buyer shall be responsible for obtaining all necessary approvals, permits, and or permissions in order for the Seller to fulfil its obligations.

5. Typographical Errors

In the event that a product is mistakenly listed at an incorrect price, Mount & Eve reserves the right to refuse or cancel any orders placed for product listed at the incorrect price as well as cancel any such order. In the case payment has been made, an issue of refund will be made to the amount of the incorrect price.

6. Payment Terms

  • In the event that the Buyer has been granted a credit account, the Buyer agrees to pay all amounts in full, within seven (7) days from the date of the invoice.
  • At the Seller’s sole discretion,
  • Full Payment will be required prior to commencement of work and release of goods.
  • Payment will be made by cash, direct deposit, credit card or by any other method as may be agreed between the Buyer and the Seller.

7. Return & Refund Policy

It is the intention of Mount & Eve to provide our customers with products that meet the specifications stated on our web site as well as our customer’s expectations. In the unlikely event that our customer’s expectations are not met, we ask that the customer emails us immediately with photos and a description of the problem and we will make every effort to reach a fast and mutually agreeable resolution. It is important to note that all of our signage is custom printed with artwork which the customer approves prior to printing, so it is essential that you select your product and check your artwork very carefully. It is also important to note that the colours in the artwork proof displayed on your screen are not accurate. Colours will print differently on different printers and materials and will display differently on different computer screens. If a colour is important it is essential that a Pantone (PMS) colour is advised prior to the artwork proof being approved, so we can do our best to achieve the closest possible colour match.

Mount and Eve will repair or replace any products which are not as stated on our web site, not as shown on the approved artwork proof (please note the above paragraph regarding colours) or are found to be defective within the warranty period stated on our web site.

In the event of a warranty issue being notified, and photos of the issue being received, Mount and Eve will:

    Require the customer to return the goods to Mount and Eve (at the customer’s cost). Mount and Eve will then repair or replace the goods and return them at no cost to the customer

    In the event of a warranty claim, Mount and Eve’ liability will be limited to the cost of repairing or replacing the goods. Mount and Eve will not be liable for any associated costs incurred by the customer as a result of a warranty claim. This includes, but is not limited to, the cost of installing the signage that is the subject of the warranty claim. It is essential that all signage is carefully inspected at time of receipt – and approved or rejected by the customer prior to the customer arranging installation of the signage.

    8. Shipping Policy

    All non-printed products that are in stock will be dispatched the next business day after an order has been placed and payment has been received.

    Our custom printed products have various shipping times based on the type of product and the value of the order. Every product page has an FAQ section below the pricing, in this FAQ section it states the time it will take to produce and ship your products after we have received sign off of your artwork proof. Our production begins the first working day after your artwork proof approval, there is a cut off time of 5pm for approving artwork to ensure it starts in production the following day.

    9. Copyright

    The entire content included in this site is copyrighted as a collective work under the Australian and other copyright laws, and is the property of Mount and Eve

    10. Limitation of Liability

    Mount and Eve shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products.

    Refunds are not offered for custom printed products.
